6 Asylum and Immigration Tribunals
Disputes involving immigration decisions are initially heard by an Asylum and Immigration Tribunal: an independent body where a panel makes a judgment based on the evidence presented before them.
There are two aspects to their work:
- Responsibility for appeals against some decisions made by the Home Office relating to permission to stay in the UK, deportation from the UK and entry clearance to the UK.
- Handling applications for immigration bail from people being held by the Home Office on immigration matters.
There are several factors to consider, including the date when the application was made and whether an individual is inside or outside the UK. An immigration adviser’s work at Level 3 may involve making applications to the First-tier Tribunal (Immigration and Asylum Chamber) on behalf of a client. Before bringing an appeal, they would check for the latest guidance and procedure, which is within the competence of a Level 3 immigration adviser.
